Tennessee State Mandates
Electronic Prescribing of Controlled Substances (EPCS)
Federal Mandate: Medicare Part D Practitioners In 2018 the SUPPORT for Patients and Communities Act was passed by the federal government. The Act includes legislation that requires Medicare Part D practitioners to begin electronically prescribing Part D drugs requiring prior authorization on January 1, 2021. Medicare Part D prescribers in every state are subject to the above stated mandate and must comply.
Tennessee State Mandate: All Prescribers Early in 2019 the Tennessee General Assembly passed Senate Bill 0810, which established that as of January 1, 2021, all controlled substance prescriptions must be electronically prescribed. The bill states there is possibility for waivers and exceptions. As an example, those who prescribe 50 or fewer prescriptions for Schedule II controlled substances per year will not be required to adopt EPCS capabilities. Prescribers in the state of Tennessee are encouraged to adopt the capability to electronically prescribe controlled substances prior to the mandatory implementation date of January 1, 2021. Those who are required to adopt EPCS capabilities and choose not to comply will be subject to penalty.
