California State Mandates
Electronic Prescribing of Controlled Substances (EPCS)
Federal Mandate: Medicare Part D Practitioners In 2018 the SUPPORT for Patients and Communities Act was passed by the federal government. The Act includes legislation that requires Medicare Part D practitioners to begin electronically prescribing Part D drugs requiring prior authorization on January 1, 2021. Medicare Part D prescribers in every state are subject to the above stated mandate and must comply.
California State Mandate: All Prescribers In 2018, the legislature of the state of California passed Assembly Bill 2789, mandating electronic prescribing for California prescribers beginning on January 1, 2022. The bill specifically requires prescribers to employ electronic prescribing for all prescriptions, and requires pharmacies to be equipped to receive said electronic prescriptions. Pharmacies must also immediately communicate with a prescriber if a sent prescription transmission fails, or if the prescription is incomplete or lacking necessary information. Those who fail to meet the requirements of Assembly Bill 2789 will be referred to the appropriate state professional licensing board and may be subject to sanctions.
